TYPO IMAGERY
Terms & Conditions
Effective Date: OCt 1st 2026
 
These Terms & Conditions (“Terms”) govern photography services provided by Typo Imagery (“Photographer,” “I,” “me,” or “my”) to the individual or organization booking services (“Client,” “you,” or “your”). By booking a session, signing an agreement, paying an invoice or deposit, or otherwise engaging Typo Imagery for photography services, you acknowledge that you have read, understood, and agreed to these Terms.
1. BOOKING & RESERVATION
A date and time are not considered officially reserved until Typo Imagery has received the required deposit and/or written confirmation specified in the applicable proposal, invoice, or service agreement.
The Photographer reserves the right to decline or cancel a booking at their discretion before services are rendered.
Specific services, deliverables, locations, dates, hours, pricing, and other project details may be outlined in a separate proposal, invoice, estimate, or agreement. If a project specific agreement conflicts with these Terms, the project specific agreement will control for that project.
2. DEPOSITS & PAYMENT
Unless otherwise specified in writing, a 25% to 50% deposit may be required at the time of booking.
The deposit reserves the agreed upon date and time and is applied toward the total balance.
Unless otherwise specified:
The remaining balance is due immediately after the photography session or event has concluded.
Payment is not contingent upon delivery of the final photographs.
For example, if the shoot takes place on June 1, the remaining balance is due after the shoot on June 1, even if the final photographs are delivered at a later date.
Typo Imagery reserves the right to withhold delivery of photographs until all outstanding balances have been paid.
3. ORGANIZATIONAL & INSTITUTIONAL PROJECTS
For organizational, commercial, nonprofit, school, corporate, or institutional projects, invoicing and payment terms may differ from individual sessions.
Unless otherwise agreed to in writing, invoices for these projects should be submitted or approved at least one week before the scheduled shoot date, and payment should be processed no later than 31 days after the shoot date.
Any alternative payment terms must be agreed upon in writing before the project begins.
4. PRO BONO & COLLABORATIVE WORK
Typo Imagery occasionally provides photography services at no charge or at a substantially reduced rate for creative collaborations, organizations, artists, athletes, community members, or other projects.
Pro bono or complimentary work does not carry the same turnaround expectations as paid work.
When photography services are provided free of charge, there is no guaranteed delivery date or guaranteed turnaround time unless a specific delivery date has been agreed to in writing.
Paid client work, contracted deadlines, commercial projects, and other business obligations may take priority over complimentary work.
As a result, photographs from a pro bono or collaborative session may take substantially longer to deliver than photographs from a paid session.
Although no delivery deadline is guaranteed for pro bono work, Typo Imagery will make a reasonable effort to complete and deliver the agreed upon work in a timely manner.
No payment or compensation is owed for a pro bono project solely because the photographs have not yet been delivered.
5. TURNAROUND TIMES
Unless a specific turnaround time has been agreed upon in writing, delivery dates are estimates rather than guarantees.
Turnaround times may vary depending on:
- Current workload
- Number of images captured
- Editing complexity
- Project scope
- Client communication
- Holidays or scheduled time away
- Equipment failure
- Illness or emergencies
- Other circumstances outside the Photographer's reasonable control
Rush delivery may be available for an additional fee when requested and agreed upon in advance.
6. COPYRIGHT & OWNERSHIP
Unless otherwise specified in a written agreement, Typo Imagery retains all copyright and intellectual property rights to photographs created during a session or project.
Payment for photography services does not constitute a transfer of copyright ownership.
The Client receives a limited, non-exclusive, non-transferable license to use the delivered photographs for the purposes specifically stated in the applicable agreement, proposal, invoice, or license.
The Client may not sell, license, transfer, sublicense, alter, commercially exploit, or otherwise distribute the photographs beyond the granted license without written permission from Typo Imagery.
Copyright ownership and usage rights are separate from possession of the digital files. Receiving a digital photograph does not mean receiving ownership of the copyright.
The U.S. Copyright Office generally identifies the photographer as the initial copyright owner of photographs, subject to exceptions such as certain work-made-for-hire arrangements. U.S. Copyright Office
7. CLIENT USAGE LICENSE
Unless otherwise specified in writing, the Client's license may include personal, social media, portfolio, website, and other agreed upon uses.
Any commercial advertising, paid media, merchandise, resale, publication, licensing to third parties, or other uses outside the agreed license require additional written permission and may require an additional licensing fee.
For organizational or commercial clients, permitted usage should be clearly defined in the project agreement whenever possible.
8. PHOTOGRAPHER'S PORTFOLIO & PROMOTIONAL RIGHTS
Unless otherwise agreed upon in writing, the Client grants Typo Imagery permission to display photographs created during the session for the Photographer's:
- Website
- Portfolio
- Social media
- Printed portfolio
- Marketing materials
- Promotional materials
- Awards and competitions
- Editorial features
- Advertising for Typo Imagery
- Educational or professional presentations
The Photographer may identify the Client, organization, event, or project when reasonably appropriate in connection with displaying the work.
The Client understands that photographs may be used to demonstrate the Photographer's work and promote Typo Imagery.
Although permission is not required for uses covered by this agreement, Typo Imagery values the relationship with its clients and will generally make a reasonable effort to communicate with the Client before publicly sharing images, particularly when the images involve a sensitive subject, personal circumstance, or representation that may reasonably warrant additional consideration.
9. REPRESENTATION & IMAGE SELECTION
The Photographer maintains artistic discretion regarding the selection and editing of photographs.
The Client understands that not every photograph captured during a session will be delivered.
The Photographer may determine which photographs are technically acceptable and appropriate for final delivery based on factors including focus, exposure, composition, expression, duplication, image quality, and artistic judgment.
Raw, unedited, rejected, test, or outtake photographs are not included unless specifically stated in writing.
10. EDITING & ARTISTIC STYLE
The Client acknowledges that they are hiring Typo Imagery based in part on the Photographer's artistic style.
Editing decisions, including color, exposure, cropping, retouching, contrast, composition, and other artistic choices, are at the Photographer's discretion unless otherwise agreed upon before the shoot.
Requests for extensive re-editing or alterations outside the originally agreed upon editing style may be subject to an additional fee.
11. CANCELLATIONS & RESCHEDULING
If the Client needs to cancel or reschedule, they should provide as much notice as reasonably possible.
Deposits may be non-refundable because they compensate the Photographer for reserving the date and declining other work.
If the Photographer is able to reschedule the session, the deposit may be transferred to the new date at the Photographer's discretion.
Repeated rescheduling or cancellations may result in the Client being required to submit a new deposit.
12. WEATHER & UNFORESEEN CIRCUMSTANCES
For outdoor sessions, weather conditions may require rescheduling.
The Photographer may recommend rescheduling when weather conditions create an unreasonable safety concern or would materially interfere with the agreed upon photography services.
Neither party will be considered in breach for delays or inability to perform caused by circumstances beyond their reasonable control, including severe weather, natural disasters, illness, emergencies, venue closures, transportation disruptions, equipment failure, or similar circumstances.
13. CLIENT RESPONSIBILITIES
The Client is responsible for:
- Arriving on time
- Providing accurate contact information
- Communicating relevant project details
- Obtaining necessary permissions from venues or locations
- Obtaining releases or permissions from individuals when required
- Ensuring that participants are prepared and available
- Communicating any specific accessibility, safety, or scheduling requirements in advance
Delays caused by the Client may reduce the amount of time available for photography and will not necessarily result in an extension of the scheduled session.
14. VENUES & LOCATION FEES
The Client is responsible for obtaining permission to photograph at any private location, venue, property, or facility unless Typo Imagery has agreed to obtain such permission.
The Client may also be responsible for location fees, permits, parking, admission fees, studio rental fees, travel expenses, or other costs associated with the selected location unless otherwise agreed upon.
15. FAILURE TO PERFORM
If Typo Imagery is unable to perform the contracted services because of circumstances within the Photographer's control, the Photographer's liability will generally be limited to the amount actually paid by the Client for the affected photography services.
If the Photographer is unable to perform because of circumstances outside their reasonable control, the parties may agree to reschedule or receive a refund of amounts paid for services that were not performed, as applicable.
16. IMAGE STORAGE & ARCHIVING
Typo Imagery will make reasonable efforts to maintain copies of delivered photographs for a limited period following delivery.
However, the Client is ultimately responsible for downloading, backing up, and preserving delivered photographs.
Typo Imagery does not guarantee permanent storage or indefinite availability of photographs.
17. SOCIAL MEDIA & CREDIT
When sharing photographs publicly, the Client is encouraged to credit Typo Imagery where reasonably possible.
Unless otherwise agreed, the Client may not remove watermarks, copyright notices, or identifying metadata from photographs.
18. MINORS
When a photograph includes a minor, the person booking the photography services represents that they are authorized to provide permission on behalf of the minor for the purposes stated in the applicable agreement.
For projects involving schools, youth organizations, athletic programs, or other groups containing minors, additional releases or organizational permissions may be required.
19. MODEL & PUBLICITY RELEASE
Where applicable, the Client and/or participating individuals grant Typo Imagery permission to use photographs containing their likeness for the Photographer's portfolio, website, social media, marketing, promotional, editorial, educational, and similar business purposes, subject to any written restrictions agreed upon before the session.
This provision is intended to establish permission for the Photographer's use of the photographs and does not transfer copyright ownership to the Client.
For projects involving minors or individuals who cannot legally provide consent, the appropriate parent, guardian, or authorized representative must provide the necessary permission.
20. PRIVACY & RESTRICTED USE
If a Client requires photographs to remain private or prohibits portfolio, website, social media, or promotional use, that restriction must be communicated and agreed upon in writing before the session.
A privacy or non-portfolio restriction may affect the project price because promotional usage is part of the value associated with some photography services.
21. RAW FILES
RAW files, unedited images, camera files, and rejected images are not included in standard photography services.
If RAW files are requested, Typo Imagery may provide them at its sole discretion and may charge an additional fee.
22. THIRD-PARTY VENDORS
Typo Imagery may use third-party services for gallery hosting, file delivery, printing, cloud storage, payment processing, or other aspects of providing services.
Typo Imagery is not responsible for interruptions or failures caused by third-party platforms outside the Photographer's reasonable control.
23. AGREEMENT & ACCEPTANCE
By booking photography services with Typo Imagery, the Client acknowledges that they have reviewed and accepted these Terms & Conditions.
A booking confirmation, signed agreement, accepted proposal, payment of a deposit, or payment for services may constitute acceptance of these Terms.
Any changes to these Terms or to the agreed upon services must be made in writing.
